Terms of Use — Parisia
Article 1 – Service provider
The Parisia service, available on the parisia.app website and in the studio.parisia.app application, is published by:
Parisee Eyewear, a single-shareholder simplified joint-stock company (SASU) with share capital of €10,000
Registered office: 166 rue Gerhard, 92800 Puteaux, France
Registered with the Nanterre Trade and Companies Register under number 101 082 428
Intra-community VAT number: FR76101082428
Contact: contact@parisia.app
In these Terms, Parisee Eyewear is referred to as “Parisia”.
PARISIA is a registered trademark operated by Parisee Eyewear.
The Service’s hosting providers are listed in the legal notice.
Article 2 – Definitions
In these Terms, the following terms have the meaning given below:
• Service: the Parisia platform, available on the parisia.app website and in the studio.parisia.app application, which allows Visuals to be created from Uploaded Images, together with the Plugin and the services associated with it.
• Tool: each of the features offered by the Service, in particular the creation of Visuals and the writing of texts (Alt Texts, file names, captions). Their list and description are available on the Service and may change.
• Account: the personal space created by the User to access the Service.
• User: any person who holds an Account.
• Uploaded Image: any photo or image that the User uploads to the Service to be processed, including through the Plugin.
• Visual: any image created by the Service from an Uploaded Image.
• Virtual Model: any fictional person, generated by artificial intelligence, who appears in a Visual. In the Service, a Virtual Model is also called a “muse” (“égérie”): both terms refer to the same concept.
• AI Provider: any third-party company that supplies the artificial intelligence models used by the Service.
• Plugin: the Parisia Media extension for WordPress, published by Parisia, which converts a site’s images into lighter formats and can add Alt Texts to them.
• Alt Text: the short description of an image, read in particular by screen readers and search engines.
• Site Key: the code provided by the Service to link a site to an Account.
• Connected Site: any WordPress site linked to an Account by means of the Plugin and a Site Key.
Article 3 – Purpose and applicable documents
These Terms set out the conditions for accessing and using the Service. They apply to every User, including during a trial period and when using the Plugin free of charge.
The terms and conditions of sale (Terms of Sale) govern the plans, including the free plan, the subscription to a plan, the purchase of image packs, prices and payment. In the event of any conflict on these matters, the Terms of Sale prevail.
The processing of personal data is described in Parisia’s privacy policy.
Creating an Account requires express acceptance of these Terms, by ticking a box at sign-up. The Terms are available at any time on the Service and are sent to the User by email upon registration.
These Terms are written in French. Translations may be provided for information only; in the event of any difference, the French version prevails.
Article 4 – Account
4.1 Registration. Access to the Service requires creating an Account. The Account is created by an adult natural person. A free Account is enough to use the Plugin free of charge. Paid plans are reserved for professionals: the person who subscribes to one acts on behalf of a company or as part of their own professional activity. When registering for a paid plan, the User declares this and states the name of their company or brand and, where available, their identification number (SIRET, VAT number or equivalent). Creating Accounts by automated means is prohibited. Parisia may put verification measures in place at registration.
The User provides accurate information and keeps it up to date. A person who creates an Account on behalf of a company declares that they are authorised to bind that company. A User who falsely claims to be a professional bears the consequences alone.
4.2 Personal use. A single person may hold only one Account. Each Account is reserved for a single user. It is personal and may be neither transferred nor shared.
4.3 Login credentials. The User keeps their login credentials confidential. Any action carried out from their Account is deemed to have been carried out by them, unless they demonstrate fraudulent use that is not attributable to them. They inform Parisia without delay of any unauthorised use of their Account.
4.4 Refusal of registration. Parisia may refuse a registration for a legitimate reason, in particular in the case of inaccurate information, lack of professional status for a paid plan, automated creation or an additional Account, or previous misuse of the Service.
Article 5 – The Service
5.1 Description. The Service allows Visuals to be created from Uploaded Images, by means of the various Tools. The list and description of the Tools are available on the Service.
5.2 Use of AI Providers. Visuals are created using artificial intelligence models supplied by AI Providers. Parisia chooses the model used for each Tool and may change it, provided that the Tool keeps its function. An AI Provider may refuse to process an Uploaded Image, in particular in application of its own safety rules.
5.3 Changes to the Service. Parisia may change the Service, in particular by adding, improving or replacing Tools, to improve its quality or for technical or legal reasons. If a change significantly reduces the Service enjoyed by a subscriber, the subscriber is informed in advance and may cancel their subscription under the conditions set out in the Terms of Sale.
5.4 Equipment. Access to the Service requires an internet connection and compatible equipment, at the User’s expense.
5.5 Plugin. The Plugin is made available free of charge. It converts images on the site’s server, without sending them to Parisia. An image is sent to the Service only to write its Alt Text, after the User has linked their site to their Account by means of a Site Key. The number of Connected Sites and Alt Texts depends on the plan, under the conditions set out in the Terms of Sale.
5.6 Site Key. The Site Key is confidential. Any use of a Site Key is deemed to have been made by the User to whom it was provided, on the same terms as for their login credentials (Article 4.3).
5.7 Alt Texts and other texts. The Alt Texts, as well as the file names and captions suggested by the Service, are written automatically by artificial intelligence, based on the image and contextual information. They may be inaccurate or incomplete: the User checks them and corrects them if necessary. Parisia guarantees neither better search ranking for the site nor its compliance with accessibility rules. The Plugin does not replace an Alt Text that is already present.
Article 6 – Uploaded Images
6.1 User’s rights. The User warrants that they hold all the rights necessary over each Uploaded Image, including the right to modify it. This is the case in particular where the photo was taken by a photographer or supplied by a third party.
6.2 People shown. If an Uploaded Image shows an identifiable person, the User warrants that they have obtained that person’s permission, or that of their legal representatives if the person is a minor, for the use of their image and its modification by artificial intelligence. They alone bear the consequences of any lack of permission.
6.3 Third-party elements. The User is solely responsible for any trademarks, logos, works or other third-party elements that appear in an Uploaded Image.
6.4 Permission granted to Parisia. The User authorises Parisia and its AI Providers to process each Uploaded Image, free of charge, for the sole purpose of creating the Visuals or Alt Texts requested. This permission does not allow any other use.
6.5 No verification. Parisia does not verify the User’s rights over Uploaded Images. The processing of an Uploaded Image does not mean that Parisia acknowledges those rights.
6.6 Third-party claims. The User indemnifies Parisia against any third-party claim, in particular from a person shown in an Uploaded Image, based on an Uploaded Image that the User had no right to use. They bear any sums that Parisia may have to pay in that respect, including reasonable defence costs.
Article 7 – Prohibited uses
7.1 Content. It is prohibited to upload an Image or to create a Visual that is:
• sexual in nature or containing nudity;
• depicting a minor in an inappropriate way, in particular of a sexual nature;
• violent, hateful, defamatory or discriminatory;
• infringing a third party’s rights, in particular its intellectual property rights or its image rights;
• making it appear, from an Uploaded Image, that a real person wears, uses or endorses a product without their consent;
• presented as a photograph taken without artificial intelligence, with the aim of deceiving;
• for political or electoral propaganda purposes;
• more generally, contrary to the law.
7.2 Use of the Service. It is prohibited to:
• access the Service by automated means, other than through the features provided by Parisia;
• attempt to break into the Service, disrupt its operation or circumvent its security measures, filters or usage limits;
• use the Service or the Visuals to develop an artificial intelligence service or model that competes with Parisia or with the AI Providers whose models it uses;
• deliberately remove the technical markings (metadata, invisible watermarks) applied by Parisia or its AI Providers to indicate that a Visual was created by artificial intelligence, with the aim of concealing its origin;
• resell or make access to the Service available to others.
7.3 Consequences. In the event of a breach, Parisia may refuse to process an Image, delete a Visual and suspend or close the Account concerned, under the conditions set out in Article 15. Parisia may report any manifestly unlawful content to the competent authorities. Checks may be carried out by automated means, in particular by the AI Providers’ safety filters.
Article 8 – Rights in the Visuals
8.1 User’s rights. Parisia claims no rights in the Visuals. It assigns to the User, from the moment they are created, the rights of reproduction, representation and adaptation that it may hold in their Visuals, worldwide, for the full duration of those rights and for any purpose, including commercial.
8.2 Free use. The User may use their Visuals freely, including for commercial purposes, in compliance with these Terms and the law. These rights apply from the trial period and continue after the subscription ends.
8.3 No warranty. Parisia does not guarantee that the Visuals are protected by an intellectual property right. The Visuals are not exclusive: because the Tools, Virtual Models and backdrops are offered to all Users, similar visuals may be created for other Users.
8.4 Texts. Articles 8.1 and 8.2 also apply to the Alt Texts, file names and captions written by the Service.
Article 9 – Use of the Visuals
9.1 Parisia’s role. Parisia provides a tool for creating Visuals. It does not publish or distribute any Visual. The User alone decides on the use, publication and distribution of their Visuals, and is responsible for them.
9.2 Nature of the Visuals. Visuals are created automatically by artificial intelligence. Their quality depends in particular on that of the Uploaded Image. A Visual may contain imperfections or differ from the actual product. Two creations from the same Uploaded Image may give different results. Parisia does not guarantee that a Visual is suitable for a particular use.
9.3 Checking. Before any use, the User checks each Visual, in particular its fidelity to the product: colours, shapes, materials, proportions and details.
9.4 Information for buyers. The User undertakes to publish only Visuals that do not mislead their own customers about the essential characteristics of their products. They are solely responsible to them.
9.5 Disclosure of artificial intelligence. It is for the User to tell the public that a Visual was created or modified by artificial intelligence, where the law requires it, in particular the European regulation on artificial intelligence.
Article 10 – Virtual Models
10.1 Nature. Virtual Models are generated by artificial intelligence. They are not real people and are not designed to represent an existing person. However, a chance resemblance to a real person cannot be ruled out.
10.2 Use. The User may use a Virtual Model only as it appears in their Visuals. They may not extract it from a Visual to use it separately, nor use it as a trademark or logo.
10.3 Availability. Parisia may change or withdraw Virtual Models at any time. It does not guarantee that a Virtual Model will remain available in the long term.
Article 11 – Retention and deletion
11.1 Uploaded Images. Uploaded Images are used solely to create the Visuals or Alt Texts requested. Parisia does not keep them: they are deleted from the Service once processing is complete, and no later than 24 hours after upload. AI Providers may keep them temporarily, under their own terms, in particular for the security of their services.
11.2 Visuals. Visuals are hosted for 30 days from the time they are made available, to allow them to be downloaded, and are then deleted automatically. During this period, Parisia does not use them. The User may also delete a Visual from their history at any time. It is for the User to download their Visuals before they are deleted. After deletion, a Visual is no longer accessible from the User’s Account and is no longer used by Parisia. The corresponding technical files may remain for some time on the infrastructure of Parisia’s hosting providers, until they are erased by them, according to their own timescales.
11.3 End of subscription. After the end of their subscription, the User keeps access to their Account to download the Visuals already created, until their 30-day period expires. They can no longer create new Visuals.
11.4 Account deletion. Deleting the Account immediately and permanently removes all Visuals from the Account; the corresponding technical files are subject to the last sentence of Article 11.2. It is for the User to download them beforehand.
11.5 Legal obligations. Parisia may keep an Uploaded Image or a Visual beyond these periods if the law so requires, in particular in the case of unlawful content.
Article 12 – Intellectual property
12.1 The Service. The Service and its elements, in particular its interface, texts, software, Tools with their settings and instructions, Virtual Models and backdrops, are protected by intellectual property law or as Parisia’s know-how. PARISIA is a registered trademark operated by Parisia.
12.2 Right of use. Parisia grants the User a personal, non-exclusive right to use the Service, for the duration of their Account and in compliance with these Terms. This right may be neither transferred nor shared.
12.3 Prohibitions. Unless Parisia gives written permission, the User may not copy, reproduce or extract all or part of the Service, nor seek to discover how it works, its settings or its instructions. The use of Virtual Models in the Visuals remains permitted under the conditions of Article 10.2.
12.4 User content. These rules apply neither to Uploaded Images, which remain the User’s property, nor to Visuals, which are governed by Article 8.
12.5 Suggestions. Parisia may freely use, without compensation, the ideas and suggestions that the User sends it to improve the Service.
12.6 Plugin code. By exception to Articles 12.2 and 12.3, the Plugin’s code is distributed under the free GNU GPL licence, as required by WordPress.org. This licence applies only to that code. It does not extend to the Service, the Tools or the PARISIA trademark.
Article 13 – Availability of the Service
13.1 Access. Parisia uses reasonable means to keep the Service continuously accessible. It does not guarantee uninterrupted availability.
13.2 Interruptions. The Service may be interrupted or slowed, in particular for maintenance or update operations, in the event of a technical incident or the failure of an AI Provider or of the hosting provider. Parisia endeavours to announce scheduled maintenance in advance. During an outage, the Plugin continues to convert images and their upload is not blocked; only the Alt Texts are not written.
13.3 Processing times. The times taken to create Visuals are indicative. They vary in particular with the volume of Uploaded Images and the load on the Service.
Article 14 – Liability
14.1 Principle. Parisia undertakes to provide the Service with care. It is bound by an obligation of best efforts (obligation de moyens).
14.2 Limits. Parisia is not liable for:
• the content of Uploaded Images or the use made of the Visuals, which are the User’s responsibility (Articles 6 and 9);
• damage caused by an event of force majeure;
• to the extent permitted by law, failures of the AI Providers or of the hosting provider that are not attributable to it.
14.3 Cap. Parisia’s liability is limited to direct damage. It may not exceed the amount paid by the User in the 12 months preceding the event giving rise to the damage, or €100 if no payment has been made. These limits do not apply in the event of gross negligence or wilful misconduct by Parisia.
Article 15 – Suspension and closure of the Account
15.1 By the User. The User may delete their Account at any time from their space. Deletion has the effects set out in Article 11.4. It ends the current subscription, under the conditions set out in the Terms of Sale.
15.2 Suspension by Parisia. In the event of a breach of these Terms, or of a risk to the security of the Service or of third parties, Parisia may suspend access to the Account. It informs the User and gives the reason, together with the means of challenging the decision, unless urgency or a legal obligation requires otherwise.
15.3 Closure by Parisia. In the event of a serious or repeated breach, Parisia may close the Account. Except in cases of urgency or manifestly unlawful content, it first invites the User to remedy the breach.
15.4 Financial consequences. The consequences of a suspension or closure for the subscription and the sums paid are set out in the Terms of Sale.
Article 16 – Complaints and reports
16.1 Complaints. For any question or complaint about the Service, the User may write to contact@parisia.app.
16.2 Reporting content. Anyone may report to the same address content that they consider unlawful or infringing their rights. The report states the identity and email address of its author, the content concerned and its exact location, and the reasons why it is disputed. It includes a good-faith statement that the information provided is accurate.
16.3 Handling. Parisia examines each report and takes the action it considers appropriate, in compliance with the law.
Article 17 – Personal data
17.1 Principle. Parisia processes the personal data necessary to provide the Service, in accordance with the applicable regulations, in particular the General Data Protection Regulation (GDPR). It uses service providers, in particular for creating Visuals, hosting and payment. The processing operations, their purposes, retention periods, service providers and individuals’ rights are described in the privacy policy, available on the Service.
17.2 Data contained in Uploaded Images. Where an Uploaded Image contains personal data, for example a person’s face, the User warrants that they may lawfully send it to Parisia to create Visuals or Alt Texts. For this data, Parisia acts as the User’s processor, under the conditions of the data processing agreement, which forms part of these Terms and is accepted at the same time as they are.
Article 18 – Changes to the Terms
18.1 Changes. Parisia may amend these Terms, in particular to take account of changes to the Service or the law. Each version is dated.
18.2 Prior notice. Any significant change is notified to the User by email at least 30 days before it takes effect. A change required by law may apply earlier.
18.3 Acceptance. The new version is submitted for the User’s acceptance at their first login after it takes effect. If they refuse it, they may delete their Account and cancel their subscription, free of charge.
Article 19 – Governing law and disputes
19.1 Governing law. These Terms are governed by French law.
19.2 Amicable settlement. In the event of a dispute, the User first sends a written complaint to contact@parisia.app, in order to seek an amicable solution.
19.3 Competent courts. Subject to mandatory rules that apply, any dispute falls within the exclusive jurisdiction of the courts of the district of Parisia’s registered office.
